Terms and conditions

1. General terms

1.1. These Rules of Purchase and Sale of Goods (hereinafter referred to as the Rules) are a legal document binding on the Parties, which establishes the rights, obligations and responsibilities of the Buyer and the Seller when purchasing goods on this online store.
1.2. The seller reserves the right to change, amend or supplement the rules at any time in accordance with the requirements established by law. Buyers would be informed about the changes of Rules in store website. When the buyer purchases on this website the rules in force at the time of placing the order applies.
1.3. We provde possibility to buy on this online store for:
1.3.1. able-bodied persons, i.e. persons who have reached the age of majority and whose capacity is not restricted by court order;
1.3.2. minors between the ages of 14 and 18 with the consent of their parents or guardians, unless they independently dispose of their income;
1.3.3. legal entities;
1.3.4. authorized representatives of all the above persons.
1.4. By approving the rules, the seller also guarantees that in accordance with 1.3. the Buyer has the right to purchase the goods in the e-shop.
1.5. The agreement between the Buyer and the Seller is considered concluded from the moment when the Buyer has formed a shopping cart in the e-shop, selected the payment method and read the Seller's rules, click the "Confirm order" button (see item 5 "Ordering goods, prices, payment procedure, terms") .


2. Protection of personal data

2.1. The buyer can order the goods in this e-shop:
2.1.1. by creating account on this website - by entering the data requested in the registration form;
2.1.2. without registering in this e-shop.
2.2. When ordering goods in the manner provided for in these rules, the Buyer must indicate in the relevant information fields provided by the Seller the personal data of the Buyer necessary for the proper execution of the order: name, surname, delivery address, telephone number and e-mail address.
2.3. By approving these rules, the Buyer agrees that the personal data of the Buyer provided would be processed for the purposes of the sale of goods and services in the e-shop, analysis of the Seller's activities and direct marketing.
2.4. By agreeing to the processing of the Buyer's personal data for the purpose of selling the goods and services in the Seller's e-shop, the Buyer also agrees to send the information notices required to fulfill the order to the e-mail address and telephone number provided by the Buyer.
2.5. By registering in the e-shop and ordering goods, the buyer undertakes to protect and not disclose the login details to anyone.


3. Buyer 's rights and obligations

3.1. The Buyer has the right to purchase goods in the e-shop in accordance with the procedure established in these Rules and other information sections of this e-shop.
3.2. The Buyer has the right to withdraw from the purchase and sale agreement with the e-shop by notifying the Seller by telephone immediately.
3.3. The Buyer may exercise the right provided for in Clause 3.2. of the Rules only if the Seller is informed of the termination of the contract within a reasonable time and does not suffer any losses as a result.
3.4. The buyer undertakes to accept the ordered goods and pay the agreed price for them.
3.5. If the data provided in the Buyer's registration form changes, the Buyer must update them immediately.
3.6. The buyer undertakes not to pass on his login details to third parties. If the Buyer loses the login data, he must immediately inform the Seller by the means of communication specified in the "Contacts" section.
3.7. By using the e-shop, the Buyer agrees with these Purchase and Sale Rules and undertakes to comply with them and not to violate the legal acts of the Republic of Lithuania.


4. Rights and obligations of the seller

4.1. The Seller undertakes to create all conditions for the Buyer to properly use the services provided by the online store.
4.2. If the Buyer tries to damage the stability and security of the Seller's e-shop or violates its obligations, the Seller has the right to immediately and without notice restrict or suspend the Buyer's access to the e-shop or, in exceptional cases, cancel the Buyer's registration.
4.3. The Seller undertakes to respect the Buyer's right to privacy of the Buyer's personal information specified in the e-shop registration form.


5. Ordering goods, prices, payment procedure, terms

5.1. In the e-shop, the Buyer can buy around the clock, 7 days a week.
5.2. The Agreement is effective from the moment the Buyer clicks the "Confirm Order" button.
5.3. The prices of the goods in the e-shop and the completed order are indicated in euros, including VAT.
5.4. The buyer pays for the goods in one of the following ways:
5.4.1. When paying using the Paysera bank-link interface.
5.4.2. When paying in cash or with a bank card in UAB "Avetus" restaurants at the time of order pick-up.
5.5. The buyer agrees to pay for the goods immediately. Only after payment for the goods is received, the goods are transferred to the customer.


6.  Delivery of goods

6.1. UAB "Avetus" does not provide delivery services. When ordering goods in the e-shop www.sushiout.lt, customers come to pick up the goods themselves.

6.2. UAB "Avetus" provides product delivery service only through partners BOLT FOOD and WOLT when purchasing goods on partner platforms. Partners are responsible for the delivery of goods through the partner platforms.


7. Product quality, warranty

7.1. The details of each product sold in the e-shop are generally indicated in the product description accompanying each product.
7.2. The Seller is not responsible for the fact that the goods in the e-shop may not correspond in their color, shape or other parameters to the actual size, shape and color of the goods due to the characteristics of the monitor used by the Buyer.


8. Return and exchange of goods

8.1. If a food product of poor quality has been sold to the buyer, the buyer has the right to:
8.1.1 require the product to be replaced by a product of the good quality;
8.1.2. return the goods to the seller and demand a refund of the money paid for the goods.
8.2. The buyer may also exercise the rights provided for in Paragraph 8.1. of these Rules in the event that an expired product is sold to him.
8.3. Foodstuffs of poor quality shall be replaced or returned at the place of purchase of the goods or at another place specified by the seller and convenient for the buyer. The buyer submits a written request and the product to the seller. The application shall indicate the defects of the goods and one of the requirements of paragraph 8 of these Rules selected by the Buyer. The application shall be accompanied by a receipt from the cash register or another document confirming the purchase-sale of the goods from this seller.
8.4. If the buyer does not submit a receipt from the cash register or another document confirming the purchase and sale of the goods issued in accordance with the established procedure, the goods shall be replaced only with the consent of the seller.
8.5. In case of disagreement between the buyer and the seller regarding the quality of the food product, the seller must apply to the State Food and Veterinary Service in writing no later than within 3 days after receiving the written request of the buyer. to the consumer.
8.6. Expenses related to food quality research shall be reimbursed in accordance with the procedure established by legal acts.
8.7. If the seller does not comply with the requirements of paragraphs 8.1 or 8.5 of these rules, the buyer may apply to the State Food and Veterinary Service, and upon receipt of written conclusions from it, notify the seller.


9. Buyer and seller responsibilities

9.1. The Buyer is fully responsible for the accuracy of the personal data provided by the Buyer. If the Buyer does not provide accurate personal data in the order form, the Seller is not responsible for the consequences and acquires the right to claim compensation for direct losses incurred by the Buyer.
9.2. The buyer is responsible for the actions taken using the e-shop.
9.3. The Seller is released from any liability in cases where the loss arises due to the fact that the Buyer, despite the recommendations of the Seller and the obligations of the Buyer, did not read these Rules, although he was given such an opportunity.
9.4. If the Seller's e-shop contains links to the web pages of other companies, institutions, organizations or persons, the Seller is not responsible for the information or activities performed there, does not maintain, control and does not represent those companies and persons.
9.5. In the event of damage, the guilty Party shall compensate the other Party directly.


10. Marketing and information

10.1. The seller may initiate various promotions in the e-shop at its discretion.
10.2. The seller has the right to unilaterally, without separate notice, change the terms of the shares, as well as cancel them. Any change or cancellation of the terms and conditions of the shares is only valid in advance, i.e. from the moment of their performance.
10.3. The Seller sends all notifications by the means of communication specified in the Buyer's order form.
10.4. The Buyer shall send all notices and questions to the Seller by e-mail.
10.5. The Seller shall not be liable if the Buyer does not receive the information or confirmation messages sent regarding the Internet connection, network disruptions of the e-mail service providers.


11. Final Provisions

11.1. These Rules of Purchase and Sale of Goods have been drawn up in accordance with the laws and legal acts of the Republic of Lithuania.
11.2. All disputes arising out of the implementation of these Rules shall be settled by negotiation. If no agreement is reached, disputes shall be settled in accordance with the laws of the Republic of Lithuania.
